We want you to fully understand your rights and obligations when you purchase the Bookcert Business Kit from us. Please read the following terms and conditions before you complete your order.

Privacy Policy

Bookcert respects the privacy of its customers and does not resell or lend email addresses or any other information.

Your individual details will not be made available to any third party.

Terms & Scope

The following terms and conditions apply to the purchase of the Bookcert Business Kit made via the Bookcert website, either directly online or via an off-line order accompanied by payment.

The contract is between Bookcert Limited (the Seller) and the person or organization named on the credit card or cheque used for payment (the Buyer).

For contractual purposes the point of sale is deemed to be England, and the date and time of sale, that when the order has been received and confirmed, either at the completion of an online transaction (confirmation of acceptance of payment), or via an email, letter or fax from us following receipt of your posted order and payment. This contract shall be governed by English Law under the exclusive jurisdiction of the English Courts.

Pricing and Payment

The price of the Kit is that held on the master file for our web page. In the event of any unauthorized tampering with these pages, the master file held at the trading premises of The Seller shall prevail. Any transaction conducted at an incorrect price will be deemed null and void and The Buyer advised within 14 days via email.

The Bookcert Business Kit is priced exclusive of UK Value Added Tax (VAT) and FOB UK. Currently, transactions made by buyers outside of the UK are exempt from UK VAT. The Seller reserves the right to add this tax to the payment transaction should such taxes change in future. Physical goods will be dispatched by air mail or courier, and corresponding shipping charges levied at the time of transaction as shown against each product description. The Buyer is responsible for paying any local taxes or delivery charges levied in the country of destination.

Goods must be paid for in advance, either using the online credit card processing facilities, or by cheque in UK pounds sterling.

Title of the goods remains with The Seller until such payments have been cleared. In the event of subsequent repudiation of payment by The Buyer's bank or paying agent, the title reverts to The Seller until any outstanding payment has been made in full.

Under the Distance Selling Regulations The Seller will give a full refund of the original purchase price, if The Buyer informs The Seller within seven working days, starting from the day after receipt of the goods, that The Buyer is rejecting the product because they are unwanted. It is the The Buyers responsibility to pay the return costs. Please note that unless the CD or software is faulty we cannot offer a refund on unsealed CDs.

The Kit, Opportunity, Support & Network

The Seller warrants that the Bookcert Business Kit will be dispatched in good condition, and within a reasonable time of placing the order. Please be advised that the actual delivery time is dependent upon our shipping partner. Estimated delivery is 2 to 3 working days from dispatch, however this can be longer. We will liase with our shipping partner on the buyers behalf if there are delivery problems, but the actual delivery time of the product is beyond our control. If for any reason, it does not arrive or is damaged, we will supply a replacement, provided that you inform us within 3 days of receipt for damaged goods and 14 days for non arrival, and carry out any instructions we make regarding providing evidence of damage or non-delivery.

For electronic files included on the Bookcert Bookkeeping Suite CD-Rom, if for any reason, the download does not work or you cannot read them properly, simply email info@bookcert.co.uk, giving details of the problems encountered, and your customer reference number, and we will send you further copies via email. Alternatively you may request us to post you a copy for an additional postage charge.

The Bookcert Home Bookkeeping Opportunity is not a get rich quick scheme, and you should not purchase the Bookcert Business Kit if you are not prepared to put in the required effort and work, as no refunds will be available.

Whilst every effort has been taken to give all information possible on this business, the outcome of entry into this business is dependent on individual application of information and effort. We can therefore accept no responsibility for the level of success achieved.

Purchasers of the Bookcert Business Kit are independent principles of their own business, and shall not be regarded as, or present themselves as agents for, employees of, partners in, or representatives of Bookcert Limited.

Start-up and technical support is restricted to email correspondence only, and will be available for 12 calendar months from receipt of the Bookcert Business Kit. Bookcert aims to provide a response to a query within 1 working day, although this may not always be feasible and may take longer. Bookcert aims to deal with any queries professionally and promptly. Start-up and technical support from Bookcert Limited is restricted to queries relating to information included within the Bookcert Business Kit only. Advice regarding accountancy, taxation, legal and other matters, outside the scope of bookkeeping will not be given. The seller advises the purchaser to seek independent professional advice from a qualified solicitor or accountant for accountancy, taxation and legal advice.

The Book-keepers Network (referred to as the network) is a trading division of Bookcert Limited. Purchasing the Bookcert Business Kit entitles the buyer to free inclusion in the ‘find a book-keeper service’ offered by the network at www.book-keepers.net. The entitlement is for a period of 12 months from receipt of the Kit. Subsequent annual membership is at the sellers standard rate. The seller permits the buyer to refer to their inclusion in the network for advertising purposes only. No warranties or representations are made by the network concerning the ability of bookkeepers included in the network to carry out bookkeeping functions, and the seller requires the buyer to make this clear in their business activities. The seller unreservedly retains the right to exclude the buyer from inclusion in the networks service, if the seller feels the buyer’s inclusion is, or would, adversely affect the network in any way. No warranty of any kind is made that the service will find clients for the buyer, and no monetary value is attached to the service as it is offered as a free addition to the Kit and/or membership of the network. Inclusion in the network refers to the buyer’s inclusion in the ‘find a book-keeper service’ only. The network is an advertising vehicle for customers of the seller who have purchased the Bookcert Business Kit and/or membership of the network. Inclusion in the network does not imply membership of a professional association.

The seller provides a website built and hosted for FREE for the first 12 months. This 12 month period starts as soon as the domain name the buyer requests is registered. This offer is open for a period of 12 months following the purchase date. Not all domain names will be available and the buyer may not get their first preference. The website consists of up to 4 pages. The buyer is able to have their trading name and contact details inserted into the website. Any further pages requested are subject to the sellers standard hourly rate for maintaining websites. Please contact the seller for these rates. It is the buyers responsibility to ensure details included on the website are correct and comply with the laws and regulations in the buyers country of trade. Domain registration for .co.uk domain names is for a period of two years and .com domains for a period of one year. Further re-registration of the domain names are at the sellers standard rate. Following the first 12 months an annual maintenance charge is payable in advance to the seller. This rate is currently £50 per year. The buyer can cancel this at any time. The buyer is free to request their domain name to be transferred to themselves or an alternative ISP at their request. Please note the buyer is responsible for paying all costs relating to the transfer.

Although the seller will make reasonable efforts to keep the buyers website operational, we cannot however guarantee that the website will always be operational and in use during the term of this Agreement. From time to time we may experience technical problems or have to perform technical updates, repairs and changes which may result in temporary service interruptions. The buyer agrees not to hold Bookcert Limited liable for the consequences of any such interruptions. In addition, we make no representation that the operation of the website will be error-free or uninterrupted and we shall not be liable to the buyer for the consequences of any such errors or interruptions (however so caused).

At the time of writing there is no legal requirement for a bookkeeper in the United Kingdom (UK) to hold any professional accounting qualifications to carry out bookkeeping activities. The Bookcert Business Kit clearly explains the type of bookkeeping work you will perform (which does not include tax advice or tax preparation), and the seller anticipates this will be acceptable in most countries. However, if you are a buyer of the Kit from outside of the UK, you are advised to perform your own checks with the relevant authorities in your own country to ensure this is the case for you. Bookcert Limited can provide contact details of the necessary authorities to make contact with on request.

The information contained in the Bookcert Business Kit is not intended as a substitute for appropriate professional advice, and you are advised to seek such advice before commencing with this or any other business opportunity.

Prewritten Letter of Engagement

The contents and use of our website do not constitute legal advice, nor does the transmission, downloading or sending of any document or other information create a solicitor/client relationship. These documents are standard styles only, and will need to be personalised to suit the buyers own specific circumstances, and should not be solely relied upon in making or refraining from making, any decision. Furthermore, laws are subject to change, and whilst every care has been taken in the accuracy of drafting these documents and their content, the information contained in the documents will, during the passage of time, become outdated. Legal advice is recommended in all circumstances.

Due to the digital nature of the documents no automatic right of refund or cancellation exists after a document has been purchased by you in accordance with Regulation 13 of the Consumer Protection (Distance Selling) Regulations 2000.

Usage of Letter of Engagement

The buyer may use the documents as many times as they wish subject to these Terms and Conditions. Changes in laws will render certain documents out of date from time to time and you will not be notified if any particular document has been amended.

It is the buyers responsibility to ensure the document complies with relevant governing laws in the jurisdiction you trade in.

No Warranties

Although every effort is made to ensure accuracy and reliability in our publications and downloadable files, no warranty is made or implied accuracy, fitness for purpose, or that the written material complies with local laws. Our company does not warrant, guarantee, or make any representations regarding the use, or the results of the use, of the Bookcert Business Kit, web sites, software, services, support or written materials in the terms of correctness, accuracy, reliability or otherwise. The user assumes the entire risk as to the results and performance of the business.

Earnings and Income Disclaimers

Any earnings or income examples, are only estimates of what we believe you could earn. There is no assurance that you will earn as much. If you rely upon these figures, you agree to accept that risk.

Monetary and income results are based on many factors. We have no way of knowing how well you will do, as we do not know you, your background, your work ethic, or your business skills and/or practices. Therefore we do not imply that you will get rich, or that you will do as well, or make any money at all. There is no assurance that you will do as well.

You agree that our company is not responsible for the success or failure of your business decisions relating to any information presented by our company, or our company products or services. The Seller is not responsible for any consequences of actions or decisions taken by the Buyer on the basis of information supplied.

Newsletters and Blogs

The information contained in our newsletters and blogs is of a general nature and no assurance of accuracy can be given. It is not a substitute for specific professional advice in yours or your clients own circumstances. No action should be taken without consulting the detailed legislation or seeking professional advice. Therefore no responsibility for loss occasioned by any person acting or refraining from action as a consequence of the material can be accepted by Bookcert Limited.

Satisfaction

We want you to be totally satisfied with your purchase of the Bookcert Business Kit. If, for any reason, you are not, please contact us in the first instance via email (info@bookcert.co.uk) where we will try to resolve any areas of dissatisfaction. In the event of an unresolved dispute, an independent third party, mutually acceptable to both the Buyer and the Seller, shall act as an arbitrator. Arbitration shall take place in the United Kingdom.
